Welcome to Attilio. These Terms of Service (the “Terms”) govern your access to and use of the services, software, and platform offered by Attilio One Inc., doing business as Attilio Inc. (“Attilio,” “we,” “our,” or “us”), including Attilio’s Life Optimization System and related services (collectively, the “Services”). By creating an account and clicking “I Agree,” you agree to be bound by these Terms. By accepting these Terms, you also acknowledge and consent to the Telehealth Consent included in Section 3 below. If you do not agree to these Terms, do not use the Services.
1. Services and Platform
Attilio provides access to its Life Optimization System (the “LOS”), a digital platform designed to help you organize, analyze, and optimize aspects of your physical and mental health, financial life, and broader personal objectives. The LOS may include data aggregation, scoring systems, modeling tools, artificial intelligence tools, and insights generated through a combination of software, algorithms, and human input. The LOS is intended to function as a self-directed tool to help you make more informed decisions. While Attilio may present information, recommendations, or suggested actions, you remain solely responsible for determining whether and how to act on that information.
2. Nature of the Relationship
Your relationship with Attilio under these Terms is limited to access to and use of the Services. Attilio is not acting as your physician, medical provider, lawyer, accountant, investment adviser, broker-dealer, or fiduciary unless the parties enter into a separate written agreement expressly stating otherwise. The Services may address topics involving health, finance, tax, and legal matters, but all information provided through the Services is for informational and organizational purposes only and is not a substitute for professional advice. You should consult qualified professionals before making decisions that could materially affect your health, finances, taxes, or legal position. Attilio does not supervise or control any third-party professionals you may engage, and such professionals are not agents of Attilio.
3. Telehealth Consent
Attilio may offer access to telehealth services through Junction and affiliated physician groups, including Openloop Healthcare and related professional medical entities. Telehealth is a way for healthcare providers to deliver care remotely using technology such as video calls, phone calls, and secure online messaging. Through telehealth, a healthcare provider may review your health information, order laboratory tests, discuss results, and provide medical advice without being physically present with you. By using telehealth services through Attilio, you understand and agree to the following: How Telehealth Works. Your healthcare provider may communicate with you remotely using video, telephone, or secure online technology. Risks of Telehealth. Telehealth involves certain risks, including interruptions, delays, unauthorized access, and technical difficulties. If the technology is not working properly, either you or your healthcare provider may discontinue the session. Alternative Options. You may choose to seek care through an in-person office visit instead of telehealth. Privacy. You agree to participate in telehealth sessions from a private location when possible, and your healthcare provider will also take reasonable steps to protect your privacy. Payment Responsibility. You are responsible for any amounts due in connection with your telehealth visit. Emergency Situations. Telehealth is not intended for emergencies. If your healthcare provider believes you need immediate medical attention, they may direct you to call 911 or go to the nearest emergency room. By accepting these Terms, you confirm that you have read and understand this Telehealth Consent, understand the risks and benefits of telehealth, have had an opportunity to ask questions, and voluntarily consent to receive healthcare services through telehealth.
4. New York and New Jersey Laboratory Pricing Notice
Patients residing in New York and New Jersey have the right under their respective state patient billing laws to request an itemized price list from BioReference for their laboratory tests.
5. Client Responsibilities
You agree to provide accurate, current, and complete information as reasonably requested to enable the Services to function properly. You understand that the usefulness and accuracy of the Services depend in part on the quality of the information you provide. You further agree to use the Services in compliance with applicable law and not to misuse, interfere with, or attempt to gain unauthorized access to any part of the Services. You acknowledge that all decisions you make based on the Services are your own and that Attilio does not control or direct your actions.
6. Data Use and Privacy
Your use of the Services is subject to Attilio’s Privacy Policy, which is incorporated into these Terms by reference. Attilio will process your information to provide, maintain, and improve the Services. Attilio may aggregate and analyze data to improve system performance and develop insights, provided that such use does not identify you personally. Attilio does not sell your personal information. Although Attilio implements reasonable administrative, technical, and physical safeguards designed to protect your information, no system can be guaranteed to be completely secure.
7. Conflict-Free and Transparency Standards
Attilio operates under its Conflict-Free, Transparency, and Trust Standards (the “Standards”), which are available on Attilio’s website and are incorporated into these Terms by reference, as they may be updated from time to time. If there is any conflict between the Standards and these Terms, these Terms will control.
8. Intellectual Property
The Services, including all software, methodologies, models, algorithms, designs, scores, content, and outputs, together with all related intellectual property rights, are owned by Attilio or its licensors. Attilio grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and any outputs generated through the Services solely for your personal, non-commercial use during the term of these Terms. You may not copy, reproduce, distribute, modify, reverse engineer, create derivative works from, or commercially exploit any part of the Services except as expressly permitted by Attilio in writing.
9. Third-Party Services
The Services may include integrations with or references to third-party products or services. These third-party services are provided by independent providers who are not controlled by Attilio. Attilio is not responsible for the performance, accuracy, availability, security, or terms of any third-party services. Any relationship you enter into with a third party is solely between you and that third party.
10. No Guarantees and Disclaimer
The Services are designed to support better decision-making, but outcomes depend on numerous factors beyond Attilio’s control. Attilio does not guarantee the accuracy, completeness, or usefulness of any information provided through the Services and does not guarantee any particular results. To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Attilio will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost opportunities, or personal or financial losses arising out of or relating to these Terms or your use of the Services. To the fullest extent permitted by law, Attilio’s total cumulative liability for all claims arising out of or relating to these Terms or the Services will not exceed the total amount you paid to Attilio for access to the Services during the twelve (12) months preceding the event giving rise to the claim. You acknowledge that this limitation of liability is a fundamental part of the allocation of risk between you and Attilio.
12. Term and Termination
These Terms begin when you accept them and continue until terminated. You may stop using the Services at any time. Attilio may suspend or terminate your access to the Services if you breach these Terms, if required by law, or if Attilio determines in good faith that continued access presents a risk to the Services or other users. Upon termination, your right to use the Services will cease immediately.
13. Modifications
Attilio may update the Services and these Terms from time to time. If Attilio makes material changes to these Terms, Attilio will provide notice through the Services or by other reasonable means. Your continued use of the Services after such notice constitutes your acceptance of the updated Terms.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.
15. General Provisions
These Terms, together with the Privacy Policy and the Conflict-Free, Transparency, and Trust Standards, constitute the entire agreement between you and Attilio regarding the Services and supersede all prior or contemporaneous understandings on that subject. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Attilio’s failure to enforce any provision of these Terms will not constitute a waiver of that provision.
16. Acknowledgement
By accepting these Terms, you acknowledge that you have read and understood them, that you understand the Services are tools designed to support your decision-making rather than replace professional judgment, and that you agree to be legally bound by these Terms.
